פסיקה חדשה מעניקה את זכויות הפנסיה של אלמנות ואלמנים לבני זוג שמיסדו את הקשר באמצעות תעודת זוגיות™ של משפחה חדשה

“אלמנה היא אלמנה בת זכויות כשהיא נושאת תעודת זוגיות™ של משפחה חדשה”.

בתביעה שהגישה גילה גרנות, לקרן הפנסיה מבטחים, לאחר פטירתו של בן זוגה המנוח גבריאל ויינטרפלד ז”ל, ביקשה הגב’ גרנות, לקבל את חלקה בכספי הפנסיה, של בן זוגה על בסיס היותה כאשתו.

קרן הפנסיה, לא נעתרה לבקשתה תחילה וגב’ גרנות, פנתה לבית הדין לעבודה, שם הוצגה בין היתר תעודת הזוגיות™ של משפחה חדשה.

בית הדין לעבודה בראשות השופט אלכס קוגן, קיבל את תביעתה והורה כי מי שנושאת תעודת זוגיות של משפחה חדשה היא אלמנה לכל דבר ועל קרן הפנסייה לשלם את המגיע לה  כאלמנתו של המנוח.

צעד גדול נוסף במיצובה ומעמדה של תעודת הזוגיות™.
