בני זוג מאותו מין, רשאים להינשא או לא ?! הדיון העקרוני

בית המשפט העליון של ארה”ב נדרש להכריע בסוגייה האם יש לאשר לבני זוג מאותו מין להינשא או לא. האם הנישואין הם חובה של המדינה כלפי אזרחיה או שמדובר בניסיון של הקהילה ההומולסבית להכתיב את סדר היום הציבורי? אלה השאלות העומדות בראשית שנת 2013 על סדר היום הציבורי בארה”ב.

מדוע זה חשוב לנו בישראל ולכל העולם :

  1. משום שסוף סוף נפתח הדיון מהי משפחה ומהם נישואים ב מאה ה 21.
  2. זהו הדיון הכי בסיסי בזכויות בני אדם באשר הם בני אדם.
  3. לראשונה תהיה בארהב הכרעה פדראלית בשאלה כל כך חשובה שכיום היא בידי כל מדינה בנפרד. במדינה אחת את/ה יכול/ה לזכות בזכויות נישואים בעוד תעבור/תעברי למדינה אחרת תאבד/י את אותן זכויות. לכך אנחנו קוראים אחידות בדין.
  4. יש סיכוי שגם הידועים בציבור יוכלו ליהנות מההכרעה.
  5. הגיע הזמן להכרעה בנושא!
